Senior Congress leader Salman Khurshid has recently said it’ll be difficult for a state government to say they won’t follow law passed by Parliament.
Khurshid told ANI: “If SC doesn’t interfere it’ll remain on statute book. If something’s on statute book, you’ve to obey law, else there are consequences.”
He said: “It’s a matter where state governments have a very serious difference of opinion with centre as far as this law is concerned. So, we would wait for final pronouncement (to be) made by SC. Ultimately, SC will decide, and till then everything said/done/not done is provisional and tentative.”
Earlier Congress leader Kapil Sibal said: “There is no way a state can deny the implementation of the Citizenship Amendment Act (CAA) when it is already passed by Parliament. He also claimed that doing so would be unconstitutional.”
He also said: “Constitutionally saying that I won’t implement it is going to be problematic and going to create more difficulties.”
Congress leader Jairam Ramesh also asserted that the state acts against the CAA will not stand legal scrutiny.
He told The Indian Express: “I know that the Kerala government has passed a resolution but it’s a political resolution. Whether it will stand the test of judicial scrutiny, I am not 100 percent sure.”
